Both her and the babies father are Heroin addicts. The father is no where to be found. She has agreed to enter a inpatient program. My husband and I have agreed to take custody and provide a great environment for her daughter. We are both foster care certified for NY since we have always forseen this happening at some point. How do we legally gain custody with the least intervention as possible? We would like to get her into pre school ASAP and her mom into treatment.

I gave my ex husband temp custody of our son last year for home schooling. I wrote up a letter stating that I was giving him temporary custody from this date until this date. i signed and dated it and mailed it to him and he was able to use it when he proved to child support he had custody of him. You can also go to a notary, you, your husband and your cousin (need state id also) and tell them you need a temporary custody affidavit . They type it up and all of you sign the paper and she puts her stamp or seal on it and signs it and that’s it. Its only temp custody you don’t need to go to the courthouse. As long as you have a document signed by you and your cousin that should work for what you need it for. To be safe tho I would do it with a notary, and most only charge 20$ to draw the paper up for you. Going to the courthouse would take alot longer to do then then notary
you get legal guardianship. You can legally make all decisions except change their names. You can draw up papers online – its very simple – and go to a bank and have a notary sign it. Im a teacher – so i see these often Custody is not temporary. You dont want custody. Custody means they belong to you – period, amen. If you see hope in the future of your sister, don’t go all the way with custody. Its expensive and life altering. Go for full legal guardianship. There are many kinds with many stipulations – people get them for many reasons to include yours, or when parents leave the country and leave their kids behind with someone. Legal guardianship allows power to insure them, make education decisions, and more….
You need to go to the court and file a court order
